General Counsel/Director of Legal Affairs

This position is not in the Classified Service of New York State, but is covered under New York State Military Law. If selected, current Civil Service employees will lose their seniority within the Classified Service, thereby exempting them from applying for promotional exams within Civil Service. As a member of the executive staff, reporting directly to The Adjutant General, General Counsel/Director of Legal Affairs is responsible for all state agency legal affairs. This position is essential personnel and critical to overall agency operations. As General Counsel, the incumbent will collectively address the full range of state agency legal issues, including but not limited to, verbal and written legal opinions on state, federal, and military laws; preparing and reviewing legislation; litigation of legal matters; reviewing contracts; advising on labor relations issues and investigations. The position manages a significant workload and assists in providing training and guidance throughout the agency on a multitude of complex state, federal and military legal matters. The Legal Affairs Directorate is a state-federal directorate and the General Counsel will work closely with the federal legal team on numerous matters. This position is management confidential (M/C) and is not covered under labor contract provision within DMNA; employment term is indefinite. The position performs responsibilities in accordance with all current and amended, DMNA policies and procedures, federal and state statutes, and where applicable, the contract bargaining agreement and requirements of the National Guard Bureau (NGB), specifically the Master Cooperative Agreement (MCA) and supporting regulations. The position requires a SECRET clearance. Responsibilities may include, but are not limited to the following:
JOB DUTIES:
o Provides legal opinions and advice on matters involving domestic law, including United States statutes, Federal regulations, State and local law, and the State Military Law. o Prepares legislation and provides comment on legislation furnished by the Office of the Counsel to the Governor and other agencies. o Represents the agency in any hearings and litigation as required, including personnel matters as necessary. Prepares and/or reviews all documents as needed. o Participates in management/Chamber meetings on behalf of TAG and agency. o Provides guidance and legal opinion on a broad range of State Active Duty matters including Line of Duty claims, use of NY military forces, and surviving dependent benefits. o The General Counsel is the agency's Ethics Officer and works closely with the Director of State Human Resources to ensure compliance with JCOPE requirements. o The position requires excellent research skills resulting in the preparation of well-written briefs, memoranda of law, stipulations, and other legal correspondence. o Oversees the handling and disposition of claims involving Division and National Guard personnel. o Works with State Human Resources during negotiations for labor agreements between the Executive Branch and the Civil Service Employees Association (CSEA); or any other collective bargaining agreement matters. o Provides legal assistance in matters concerning the State Organized Militia. o Coordinates the Joint Directorates on requisite Executive Orders and/or Proclamations when the Governor orders the Organized Militia to State Active Duty. o Coordinates with the Office of the State Inspector General and has oversight role regarding agency investigations. o Will complete and attend training as required. o May have to travel via various modes of transportation to meet job requirements. o May train and supervise staff. o Schedule adjustments may periodically be required. o Additional hours may periodically be required. o All other legal matters as necessary and assigned. KNOWLEDGE, SKILLS, AND ABILITIES o Must be proficient in Microsoft Office Suite. o Must have strong organizational skills. o Strong written and verbal communication skills. o Ability to prepare written material in a clear and concise form. o Ability to organize appropriate factual and legal data into clear and logical sequences. o Ability to analyze legal issues and identify significant cases, opinions, and facts. o Ability to communicate information clearly and succinctly in both oral and written form. o Will be required to appropriately handle and manage confidential information. o Ability to read and write in English. o Demonstrate reliability and trustworthiness. Preferred Skills:
o Firsthand knowledge of National Guard structure and organization at the Federal and State levels. o Working knowledge of New York State legal processes; especially in a unionized environment. o Working knowledge of the legislative process.

Salary Range:
From $137883 to $173431 Annually
Minimum Qualification
This position is not in the Classified Service of New York State, but is covered under New York State Military Law. If selected, current Civil Service employees will lose their seniority within the Classified Service, thereby exempting them from applying for promotional exams within Civil Service. Juris Doctorate Degree from an accredited law school plus six years' experience in the legal field. Experience in the military legal field is desirable. At least two years of the qualifying experience must have been at the supervisory level. AND Must be admitted to practice law in New York State and must be a member in good standing of the bar of the State of New York at the time of appointment. AND Must have a current SECRET clearance. AND In accordance with NGB standards, will be required to obtain and maintain a favorable background investigation, and have an appropriate clearance to allow access to computer networks and restricted areas to determine suitability, loyalty, and trustworthiness. Must have and maintain a valid driver's license to operate a motor vehicle in the State of New York. May be required to utilize vehicles for site visits and other travel. Must report any changes in driver's license status to supervisory chain of command. Must be proficient in, and able to independently use Microsoft Office software - MS Word, Excel and Power Point. Ability to use Access also preferred. Within Ninety (90) days of receiving computer access must successfully complete all data system training to include Statewide Financial System and the Statewide Learning Management System (SLMS) as related to job assignments. Should related systems, regulations, procedures and requirements change, additional training and/or certifications may be required. Other levels of work experience, including military, will be considered, however, candidate must demonstrate direct relevance and comparable experience to the job duties noted above and have the appropriate educational and NYS Bar requirements to practice law in New York. An expired SECRET clearance eligible for renewal may be considered. At all times, the employee MUST maintain minimum standards in accordance with current agency requirements and directives noted above; failure to do so will subject the individual to disciplinary action, including possible termination. The fraudster will send a check to the victim who has accepted a job. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
